Falk\, Professor emeritus\nof internationa l law at Princeton University.\nAbstract: The recent drone killing of Anwa r\nAl-Awlaki in Yemen has generated a high quality debate about the\ninter national law implications of such activities.\nAs my title suggests\, this core issue in this debate is\njurisprudential\, whether international law embodies the major\npremise of the rule of law that equals must be treate d equally or\nrests on a hierarchical principle that some states can make rules\nlegalizing their behavior without creating a legal precedent that\n can be relied upon by other states.\nMy argument is that the attempted leg alization of drone attacks\nrests on the capacity of the United States to generate a legal\noption that is not reciprocally available to other sover eign states\nor to non-state political actors.
